Effective January 30, 2019, the Centers for Medicare & Medicaid Services (CMS) has ended the Medicare Provider Enrollment Moratoria that has been in effect since 2013. There will be new tools, including the Review Choice Demonstration (RCD), which will manage the integrity of Home Health Agencies and Hospices and protect against fraud, waste, and abuse of Medicaid/Medicare. While the National Association for Home Care & Hospice, or NAHC, believes that another moratorium is remote, they also state that it would “be prudent to move soon to submit an application and to stay attentive to advancing the certification process” (https://www.homecaremag.com/news/home-health-provider-moratorium-lifted.)
In July of 2013, the Centers for Medicare & Medicaid (CMS) froze Medicare provider enrollment in Miami-Dade County, Florida and Cook County, Illinois due to widespread fraud, abuse, and waste. This also affected counties surrounding Miami-Dade (FL) and Cook, (IL) and was then expanded to include counties in Florida, Illinois, Michigan, and Texas. August 2016 saw the expansion of the moratoria statewide in Florida, Michigan, Illinois, and Texas and by February 2018 the states of Pennsylvania and New Jersey were added to the list.
As of January 30, 2019, this moratorium has been lifted and new Home Health Agencies and Hospices are welcome and encouraged to open within the affected states. Additional safeguards have been included to prevent waste, fraud, and abuse of Medicare and Medicaid monies; however, that also means that providers will now have more paperwork and more federal and state oversight.
